Terms of Service | Consu
These Terms of Service govern your use of the Consu mobile application. By downloading, installing or using Consu you agree to these Terms. If you do not agree, do not use the app.
1. The service
Consu is a personal media-tracking app for films, TV shows, games, books and music. It lets you build a library, rate and annotate items, import from other services, follow other users, choose how much of your profile they can see, build shared lists with other people, discover titles through other people's libraries, and view statistics about your consumption habits.
Consu is provided by Karl Holmes, a sole developer based in Ireland, contactable at support@getconsu.com.
2. Eligibility
You must be at least 13 years old to use Consu. If you are under the age of digital consent in your country (16 in Ireland and much of the EEA), you need permission from a parent or legal guardian.
3. Your account
When you open the app for the first time, Consu creates an anonymous account linked to a random unique identifier. You can optionally link this account to a Google or Apple sign-in to enable cross-device sync and recover your library if you reinstall.
You are responsible for keeping your linked sign-in credentials secure, the content you add to the app, and the accuracy of anything you make visible to other people.
You can delete your account at any time: scroll to the bottom of Settings and tap Delete My Account & All Data. Deletion is permanent. What it removes, and the few things that stay with other members of a shared list, are set out in section 8 of our Privacy Policy.
4. Acceptable use
You agree not to use Consu to harass, threaten, defame or impersonate another person; upload, share, or display unlawful, obscene, hateful, or infringing content; attempt to reverse-engineer or circumvent licensing mechanisms; scrape or mass-extract data; or interfere with the service.
Consu has zero tolerance for objectionable content and abusive behaviour. You can report a profile or block another user at any time from within the app (open a profile, then use the report or block option); blocked users are listed under Settings โ Blocked Users, where you can also unblock them. We review reports and may remove content and suspend or terminate the accounts of offending users, typically within 24 hours of a valid report. We may also suspend or terminate your access for breaches of these rules, and remove content you have uploaded for repeated or serious violations.
4.1 Shared Lists and Together queues
Consu offers two features that are shared with other people by design: Shared Lists, where a group adds and votes on titles, and Together queues, where two people build a queue between them. Creating a shared list adds your mutuals as members.
By using them you accept that:
- Every member can see the list, who its members are, the titles you add, your display name against them, and everyone's votes. This is the point of the feature, and your profile-visibility setting does not restrict it.
- You are responsible for what you add, including list and queue names, which must meet the standards in section 4.
- The content of a list belongs to the list. If you leave, or delete your account, you are removed as a member but the titles and votes you contributed remain for the others. Remove them first if you want them gone.
- We may remove a list, a queue, or an item in one, if it breaches these Terms.
5. Third-party content
Metadata about films, TV shows, games, books and music is supplied by third parties (including TMDB, OMDB, IGDB, RAWG, Steam, Nintendo, Microsoft/Xbox, Sony/PlayStation, Google Books, Open Library, the New York Times, Deezer, MusicBrainz, ListenBrainz, the Cover Art Archive, Wikidata, Wikipedia and the Apple iTunes Search API). This content is provided "as is" without warranty of accuracy or completeness. Cover art and other artwork remain the property of their respective owners and are shown for identification of the title you are tracking.
Consu may also link you to other services, such as an Internet Archive page where a book can be borrowed. We do not control those services and are not responsible for their content or availability.
Streaming and rental availability is sourced from TMDB's watch-provider data, powered by JustWatch, and is shown with the attribution that data requires. Availability varies by region and changes without notice; Consu does not sell, rent or provide access to any title, and a listing is not a guarantee that a title is available to you.
This product uses the TMDB API but is not endorsed or certified by TMDB. Game data is provided by IGDB.com. Consu is not affiliated with, endorsed by, or certified by TMDB, IGDB, Twitch, Amazon, RAWG, Valve, Nintendo, Microsoft, Sony Interactive Entertainment, Google, Apple, the Wikimedia Foundation, JustWatch, or any media publisher.
5.1 Importing from other services
Consu can import your data from other services, including a TV Time export, a Letterboxd CSV export, a Goodreads CSV export, a Spotify listening-history export, a Steam profile you identify, and a ListenBrainz username you connect. You are responsible for ensuring you have the right to the data you import and for the accuracy of what you bring in.
Consu is not affiliated with, endorsed by, or partnered with TV Time, Letterboxd, Goodreads, Amazon, Spotify, Valve/Steam, ListenBrainz or MetaBrainz. These importers depend on services outside our control and may stop working, change, or be withdrawn at any time without notice.
6. Consu Pro (paid upgrade)
Consu Pro is an optional, one-time in-app purchase that unlocks additional features. Pro is a one-time purchase, not a subscription, and carries no recurring charge. Payment is processed by the app store you purchased through โ the Apple App Store on iOS or Google Play on Android โ and purchase receipts are validated by RevenueCat.
If you buy Pro and later reinstall the app or switch device, use Restore Purchases โ near the top of Settings, beneath the Consu Pro card โ to recover it.
6.1 Refunds
Pro is a digital product made available immediately on purchase. EU consumers consent to immediate performance, and the statutory 14-day right of withdrawal does not apply once delivered.
Where the law requires a refund, or if you were charged in error, you may request one through the refund process of the store you purchased from (the Apple App Store or Google Play), or by emailing support@getconsu.com. Refunds for Apple App Store purchases are handled solely by Apple.
7. Intellectual property
The Consu app, its name, logo, design and code are owned by Karl Holmes. You retain ownership of content you create in the app.
When you make part of your profile or library visible to other people โ by setting your profile to Mutuals or Public, contributing to a Shared List or Together queue, sending a recommendation, reacting to someone's activity, or appearing in the activity feed or the Explore surface โ you grant Karl Holmes a limited, royalty-free licence to store, reproduce, display and transmit that content to the people you have made it visible to, and only as necessary to provide that service. This licence covers only what your own choices expose, and it is not exclusive.
The licence ends for future display when you change those settings or delete the content or your account, with one necessary exception: content you contributed to a Shared List or Together queue, or sent to another person, stays available to the people you shared it with until it is removed from the list or from their account, as described in section 4.1.
You may not reproduce, redistribute, or create derivative works based on the app without written permission.
8. Copyright complaints (DMCA)
Consu respects intellectual-property rights and expects users to do the same. Consu is a personal tracking app and does not host media files, but users can add titles, notes, custom lists and profile content, and the app displays metadata and artwork supplied by third parties.
If you believe content shown in or shared through Consu infringes your copyright, send a notice to support@getconsu.com including:
- your name and contact details;
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing and where it appears in the app (for example a profile, a shared list, or a specific item), with enough detail for us to locate it;
- a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf;
- your physical or electronic signature.
We will remove or disable access to material that is the subject of a valid notice, and we will terminate the accounts of repeat infringers. If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same address and we will review it.
9. Apple App Store
The following additional terms apply when you download Consu from the Apple App Store. You acknowledge and agree that:
- These Terms are concluded between you and Karl Holmes only, and not with Apple. Apple is not responsible for Consu or its content.
- Apple has no obligation to furnish any maintenance or support services for Consu.
- In the event of any failure of Consu to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Consu.
- Apple is not responsible for addressing any claims by you or a third party relating to Consu or your possession and/or use of it, including product-liability claims, any claim that Consu fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation.
- Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that Consu or your use of it infringes that third party's intellectual-property rights.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- You must also comply with any applicable third-party terms of agreement (for example, your wireless data-service agreement) when using Consu.
10. Availability and changes
Consu is provided on an "as is" and "as available" basis. We may modify, suspend or discontinue features, push updates that change behaviour or appearance, and take the service offline for maintenance.
We will give reasonable notice of material changes where practical.
11. Disclaimer
To the fullest extent permitted by law, Consu is provided without any warranty, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy.
We do not guarantee the app will be uninterrupted, secure or error-free, that results will meet your requirements, or that third-party metadata will be accurate, complete, or up to date.
12. Limitation of liability
To the fullest extent permitted by law, Karl Holmes will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, revenue, goodwill, or anticipated savings.
Nothing limits liability that cannot lawfully be limited โ particularly for death or personal injury caused by negligence, fraud, or matters under the Irish Sale of Goods and Supply of Services Act 1980.
Where liability is not excluded, total liability is limited to the greater of the amount you paid for Consu Pro in the preceding 12 months, or โฌ50.
13. Termination
You may stop using Consu by deleting the app and optionally deleting your account from Settings.
We may terminate your access if you materially breach these Terms, continuing would expose us to legal liability, or we discontinue the service.
On termination, sections 4.1, 5, 7, 8, 9, 11, 12, 14 and 15 survive.
14. Governing law
These Terms are governed by the laws of Ireland and subject to the exclusive jurisdiction of the Irish courts, except that EEA consumer residents retain the mandatory consumer-protection rules of their country and may bring proceedings there.
If we cannot resolve a dispute directly, EU consumers may refer it to a certified alternative dispute resolution (ADR) body in their own country, or seek guidance from their national European Consumer Centre (https://ec.europa.eu/info/live-work-travel-eu/consumer-rights-and-complaints/resolve-your-consumer-complaint_en). We are not obliged to use, and do not commit to using, any particular ADR scheme.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the app before taking effect. Continued use of Consu after a change constitutes acceptance of the revised Terms.
